The Hazardous Waste (England and Wales) Regulations 2005

Made: 23-03-2005 | Laid: 24-03-2005 | Forced: 24-03-2005

Overview

These Regulations make provision for the controlled management of hazardous waste from the point of production to the final point of disposal or recovery. Movement of hazardous waste must be documented in consignment notes and records of its disposal and recovery must be kept. It is essential that tracking and movement controls are applied, and these regulations place more responsibility on those who produce the waste to be more focused in their waste management control.

Background

Hazardous waste must be correctly controlled, and its movement tracked. You have a duty of care to make sure that any hazardous waste produced or handled by your business doesn’t harm or damage people or the environment. You must also make sure that waste is recovered or disposed of without endangering human health and without using processes or methods that could harm the environment.

Examples of hazardous waste include:

  • Asbestos
  • Chemicals
  • Batteries
  • Solvents
  • Pesticides
  • Oils (except edible ones)
  • Equipment containing, ozone depleting substances, like fridges and hazardous waste containers
