The Collection and Disposal of Waste Regulations 1988

Made: 03-05-1988 | Laid: 11-05-1988 | Forced: 11-05-1988

Overview

The Collection and Disposal of Waste Regulations 1988 define three categories of controlled waste: household, industrial, and commercial waste, and provide detailed lists of what falls under each category. These definitions remain legally in force and are still the source of classification for controlled waste in the UK.

While most provisions relate to household waste collection and will not affect businesses, the classification schedules are relevant for organisations that need to identify whether their waste is considered industrial or commercial. For example, commercial waste includes waste from offices, showrooms, and similar premises, which means many businesses fall under this category for waste duty of care purposes.

Although these regulations have not been revoked, modern legislation such as the Environmental Protection Act 1990 and the Waste (England and Wales) Regulations 2011 builds on and supersedes their practical requirements.
