Overview


These Regulations set out the list of hazardous substances for the purposes of the Town and Country Planning (Scotland) Act 1972, which requires consent for the presence at or above land of excess of a controlled quantity of a hazardous substance. It also, among other things, sets out the procedure to obtain consent and the procedure for enforcement of hazardous substances control. It is important to note that much of this Regulation has been amended by the Town and Country Planning (Hazardous Substances) (Scotland) Regulations 2015.
