The Code of Practice (Requests for Flexible Working) Order 2024 aims to provide guidance and clarity on flexible working arrangements for both employers and employees in the UK. It sets out the process for making and responding to requests for flexible working arrangements.
Previously, employees were required to have been working for at least 26 weeks before being able entitled to make changes to their working arrangements, such as working hours, times, or location. Now, this is no longer the case and under the Employment Relations (Flexible Working) Act 2023 employees can request flexible working arrangements from their first day of employment.
This Code of Practice (Requests for Flexible Working) Order 2024 establishes that on the 6th April 2024, the revised Code of Practice for flexible working requests issues by ACAS will come into effect.
Breach of this code does not automatically make someone liable under legal proceedings. However, compliance with the code will be considered in employment hearings. Additionally, the language used in the code reflects different compliance requirements:
