The Road Traffic (Vehicle Emissions) (Fixed Penalty) Regulations 1997 grant local authorities the authority to issue fixed penalty notices to vehicle users who breach or fail to adhere to the Road Vehicles (Construction and Use) Regulations 1986 relating to emissions of smoke, vapour, gases and oily substances.
Under these 2002 Regulations, a local authority in England has the option to seek designation from the Secretary of State. Once designated, the local authority can utilise fixed penalty notices to enforce offences related to regulations 61 and 61A of the 1986 Regulations stated above.
The 2002 Regulations apply to England only. The 1997 Regulations remain in force for Scotland and Wales.
