The Immigration (Leave to Enter and Remain) (Amendment) Order 2024 amends the Immigration (Leave to Enter and Remain) Order 2000.
It extends the period before which immigration permission lapses for individuals granted leave under Appendix EU to the Immigration Rules, which implements the EU Settlement Scheme. Previously, individuals granted limited leave (pre-settled status) under this scheme would have their leave lapse if they were absent from the UK and Islands for more than two years, while those with indefinite leave (settled status) would have their leave lapse after more than five years' absence. The amendment extends the absence period to five years for both limited and indefinite leave holders under Appendix EU. This means that individuals granted leave under this scheme can now be absent from the UK and Islands for up to five years before their immigration permission lapses.
