Overview


Commission Regulation (EU) 2018/395 sets detailed operational rules for balloons across the EU. It establishes both basic operational requirements (Subpart BAS) applicable to all balloon operators, and additional requirements (Subpart ADD) for those conducting commercial passenger ballooning (CPB). The Regulation prioritises safety while adopting a proportionate, risk-based approach, removing the need for full certification for certain commercial operators but requiring formal declarations of capability and compliance.

Adopted under Regulation (EC) No 216/2008, this Regulation harmonises safety rules for balloon operations while recognising their lower complexity compared to other forms of commercial aviation. It applies to manned lighter-than-air aircraft such as hot-air balloons, gas balloons, mixed balloons, and hot-air airships. Operators must meet strict requirements for safety management, crew competence, equipment, risk assessments, and reporting, with special provisions for introductory flights, competitions, and flying displays.
