These Regulations were made in exercise of powers conferred on the Scottish Ministers by the New Roads and Street Works Act 1991, and prescribe the qualifications required when undertaking certain types of road works. They also replace the The Road Works (Qualifications of Supervisors and Operatives) (Scotland) Regulations 1992.
The 1991 Act requires that for each road works site there is at least one trained operative on site at all times and that there is one person qualified as supervisor.
