Overview


The Fire Safety Regulations form part of the reform of Scottish fire safety law under the 2005 Act, and provide further guidance on what is required by employers and managers to comply with the Act.  Much of the Regulations replicates the current workplace fire precautions legislation. The inclusion of these provisions in the Regulations extends their application to non-workplaces to which the new fire safety regime will apply, such as Houses in Multiple Occupation. The Regulations have 4 Parts:

  • Part I consists of citation, commencement and interpretation provisions;
  • Part II sets out further requirements in respect of fire safety risk assessments;
  • Part III details specific duties in relation to fire safety in relevant premises; and
  • Part IV contains a number of miscellaneous provisions (maintenance of measures provided in relevant premises for the protection of fire- fighters; maintenance of measures provided in the common areas of private dwellings for the protection of fire-fighters; arrangements with the Office of Rail Regulation; nominated person’s act or omission not to afford employer defence; service of documents; and dis-application of certain provisions).
