Sick Leave Act 2022 (Rep. of Ireland)

Made: 20-07-2022 | Laid: 20-07-2022 | Forced: 20-07-2022

Overview

The Sick Leave Act 2022 establishes a statutory right to paid sick leave for all employees, marking a significant step in aligning Ireland with European labour standards on worker protections. The legislation is designed to support employees who are unable to work due to illness while ensuring fair and consistent practices across workplaces.

The Act introduces a phased entitlement to paid sick leave, beginning with three days (in 2023), rising to five days (2024), and increasing to ten days by 2026. This entitlement is to be paid by the employer at 70% of the employee’s wage, subject to a daily maximum. To qualify, employees must have completed 13 weeks of continuous employment and provide a valid medical certificate. Compliance not only safeguards against legal risk but also fosters a culture of care and fairness in the workplace.

Benefits of compliance may include:

  • Workforce Protection: Encourages a healthier workplace and reduces presenteeism.
  • Legal Assurance: Protects businesses from legal penalties and tribunal claims.
  • Workplace Equity: Ensures consistency and fairness in how sick leave is managed.
