Overview


These Regulations set out to control pollution levels at landfill sites. Conditions for landfill permits are set out and landfills must be classified as operating for hazardous waste, non-hazardous waste or inert waste.

Background

These regulations implement Council Directive 99/31/EC on the landfill of waste (‘the Landfill Directive’) in England and Wales. The directive defines landfill as ‘a waste disposal site for the deposit of the waste onto or into land’.
 
Landfill sites include:
  • Where a waste producer carries out its own waste disposal on its production site 
  • Permanent landfill sites of more than one year, used for temporary waste storage

The following are not landfill sites:

  • Storing waste before its disposal, for less than a year
  • Storing waste prior to recovery or treatment, for less than three years
  • Areas where waste is unloaded to prepare for it to be transported elsewhere for treatment or disposal

It is important to note that these Regulations were revoked by the The Environmental Permitting (England and Wales) Regulations 2007.
